Terms & Conditions
Effective date: June 12, 2026 · Xperience Landscaping, a division of Xperience Roofing, LLC · Contractor License No. 11606977-5501
1. Company Information
Xperience Landscaping provides residential and commercial landscaping and related services, including landscape design and installation, hardscape construction, irrigation systems, xeriscaping, and exterior improvements. The company operates through licensed contractors where required, with Utah licensing regulated through the Department of Commerce Division of Professional Licensing.
2. Website Use
You agree not to violate laws, submit false information, interfere with website security, access non-public systems, or misuse content without permission. Access may be restricted if these terms are violated.
3. No Contract Created by Website Use
Submitting a form, requesting an estimate, calling our company, texting us, or communicating with our team does not create a binding construction contract. Binding agreements require signed written documents.
4. Estimates, Site Visits, and Recommendations
Estimates may change due to site conditions, soil or grading issues, utility locations, codes, material availability, permits, customer requests, weather, and pricing changes. Unless stated otherwise in a signed contract, estimates are not guaranteed final prices. Rebate amounts shown on this website are estimates based on published water district program rates and do not guarantee program approval or payment — final rebate eligibility and amounts are determined solely by your water district.
5. Customer Responsibility for Payment
Unless otherwise stated in a signed agreement, the customer is responsible for all amounts due under the contract, including upgrades, change orders, and any amounts not paid by third parties, rebate programs, or financing providers.
6. Scheduling and Weather Delays
Project schedules may be affected by weather, material availability, permits, labor, safety, supplier delays, customer responsiveness, and unforeseen conditions. Xperience Landscaping is not responsible for reasonable delays caused by conditions outside its control.
7. Materials and Product Availability
Materials, plants, and products may vary by availability, region, season, and supplier. We make reasonable sourcing efforts but do not guarantee availability unless expressly stated in a signed agreement. Substitutions may be required.
8. Change Orders
Any work outside the original signed scope may require a written change order. Change orders may affect cost, timeline, materials, labor, warranties, and completion dates. Verbal requests may not be binding unless confirmed in writing by Xperience Landscaping.
9. Permits, Codes, and Compliance
We make reasonable efforts to comply with permitting and building code requirements. If code-required work is discovered after the initial estimate, additional charges may apply unless included in the signed scope of work.
10. Warranties
Workmanship warranties are described in signed contracts or warranty documents. Manufacturer and grower warranties are provided by manufacturers and growers, not Xperience Landscaping. Warranty coverage may be limited or voided by customer damage, third-party work, storms, neglect of watering or maintenance, pre-existing conditions, or work performed by others.
11. Maintenance
Customers are responsible for normal property and landscape maintenance, including watering, pruning, fertilization, irrigation system winterization, and timely reporting of visible issues. Maintenance failure may affect warranty coverage.
12. Photos, Videos, and Marketing Use
We may take photos and videos for estimating, production, quality control, documentation, and training. Unless a customer objects in writing, Xperience Landscaping may use non-sensitive project photos or videos for marketing, advertising, social media, website content, case studies, internal training, or portfolio purposes. Private information will not be intentionally published.
13. Reviews and Testimonials
Customer reviews and testimonials must reflect honest opinions and real experiences. We do not use fake reviews or misleading testimonials. Customer reviews may be displayed from various platforms subject to applicable law.
14. Website Content
All website content, including text, images, graphics, logos, videos, icons, layouts, designs, and branding, is owned by or licensed to Xperience Landscaping unless otherwise stated. You may not copy, modify, distribute, or use content for commercial purposes without permission.
15. Third-Party Links
The website may contain links to third-party sites, including water district rebate programs. Xperience Landscaping is not responsible for third-party websites, policies, products, services, content, availability, or security.
16. Financing
Financing options may be provided by third-party lenders. Financing approval, terms, rates, fees, and payment obligations are determined by the financing provider, not Xperience Landscaping. We do not guarantee financing approval or specific terms.
17. Communication Consent
By submitting contact information, you authorize Xperience Landscaping to contact you by phone, text message, email, voicemail, or other communication methods regarding your inquiry, appointment, estimate, project, account, or related services. You may opt out of marketing texts by replying STOP. See our SMS Terms & Consent page for full program details.
18. Privacy
Website use may involve personal information collection. Please review our Privacy Policy for details on how information is collected, used, stored, and protected.
19. No Professional Advice
Information on this website is not legal, insurance, engineering, architectural, horticultural, tax, or financial advice. Consult qualified professionals for situation-specific guidance.
20. Limitation of Liability
To the fullest extent permitted by law, Xperience Landscaping is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from website use, communications, project delays, third-party conduct, rebate program decisions, supplier delays, or events outside our reasonable control.
21. Indemnification
You agree to indemnify and hold harmless Xperience Landscaping, its owners, officers, employees, contractors, and affiliates from claims arising from website misuse, term violations, false information, unauthorized content use, law violations, or third-party claims outside the company’s control.
22. Dispute Resolution
Disputes begin with good-faith informal resolution. If unresolved, the parties follow the dispute-resolution processes in signed contracts, which may include mediation, arbitration, or court proceedings. The signed project agreement controls over these website terms if there is any conflict regarding project-specific dispute resolution.
23. Governing Law
These terms are governed by the laws of the state where services are provided. For Utah projects, Utah law applies, without regard to conflict-of-law principles, unless a written contract states otherwise.
24. State-Specific Requirements
Certain states, counties, cities, or municipalities may require specific notices, license disclosures, cancellation rights, lien notices, contract language, or consumer-protection disclosures. State-specific requirements control over conflicting terms.
25. Website Availability
We do not guarantee the website will always be available, uninterrupted, error-free, secure, or virus-free. Parts of the website may be updated, suspended, modified, or discontinued at any time.
26. Updates to These Terms
We may update these Terms & Conditions at any time, with revised effective dates posted to this page. Continued website use after updates means acceptance of the revised terms.
